Calculator and Website Disclaimer

This Disclaimer applies to the NicheWeb Calculators website, hosted calculator platform, calculator embeds, results, charts, tables, reports, emails and related content.

The platform is operated by Clark Family Pty Ltd as Trustee for The Clark Family Trust, trading as NicheWeb Calculators, ABN 35 957 893 714 (“NicheWeb”, “we”, “us” or “our”).

1. General information only

The calculators, results and Reports made available through the Service are general information and estimation tools only. They are intended to help users explore hypothetical scenarios and understand how selected inputs and assumptions may affect an indicative result.

They do not take into account every matter that may be relevant to a particular person, business, transaction, product or jurisdiction.

2. No personal advice

Nothing provided through the Service constitutes or should be relied upon as:

  • financial product advice;
  • credit assistance or credit advice;
  • insurance advice or a recommendation about insurance cover;

  • legal advice;

3. Estimates, assumptions and rounding

Calculator results depend on information entered by the user and on assumptions, formulas, rates, thresholds, periods and rounding rules built into the relevant Calculator.

Results may differ from real-world outcomes because of factors including:

  • fees, taxes, duties and transaction costs;
  • interest-rate changes, compounding methods and repayment timing;
  • lender, insurer or product-provider policies;
  • eligibility, underwriting, serviceability and credit criteria;
  • product definitions, exclusions, waiting periods and benefit limits;
  • tax treatment and changes in law;
  • inflation, investment performance and economic conditions;

  • differences between simplified calculator assumptions and actual contracts.

Figures may be rounded for presentation. Small rounding differences can accumulate over time, particularly in amortisation schedules and long-term projections.

4. No guarantee of accuracy or currency

We take reasonable care in developing and maintaining the Calculators, but we do not guarantee that every Calculator, formula, assumption, rate, threshold, label or result is complete, accurate, current or suitable for every purpose or jurisdiction.

Laws, product terms, market conditions, interest rates, tax settings, insurance definitions and industry practices can change. Users should independently verify any information that may affect a decision.

5. No quote, approval or offer

A Calculator result or Report is not:

  • a loan approval or indication that credit will be approved;
  • an insurance quotation, offer of cover or underwriting decision;
  • a commitment by a lender, insurer, broker, adviser or other provider;
  • a guarantee of repayments, savings, interest costs, premiums, benefits or returns;

Actual terms and outcomes can only be confirmed by the relevant provider after assessment and, where applicable, underwriting, verification, valuation or credit approval.

6. Subscriber responsibility

Calculators may appear on websites operated by independent subscribers such as insurance brokers, finance brokers, mortgage brokers, advisers, agencies, publishers or lead-generation businesses.

Unless expressly stated otherwise:

  • the Subscriber is independent from NicheWeb;
  • NicheWeb does not endorse or recommend the Subscriber;
  • NicheWeb is not responsible for advice, representations, products or services provided by the Subscriber; and
  • the Subscriber is responsible for its own licences, disclosures, conduct and compliance obligations.

A Subscriber’s branding or contact details in a Calculator or Report do not mean that NicheWeb has reviewed or approved that Subscriber’s services.

7. User responsibility

Users are responsible for:

  • entering complete and accurate information;
  • reviewing inputs, assumptions and results;
  • considering whether a Calculator is relevant to their jurisdiction and circumstances;
  • obtaining independent professional advice; and
  • making their own decisions.

Users should not make, delay or avoid a financial, credit, insurance, tax, legal or business decision solely because of a Calculator result.

8. Reports and emails

Reports reproduce information entered by the user and results produced at a particular time. A Report may become outdated and should not be treated as a continuing recommendation or current statement.

Email delivery is not guaranteed. Users should check spam or junk folders and verify that the email address entered is correct.

9. Illustrations and future projections

Any forecast, savings estimate, repayment comparison, balance projection, insurance-needs estimate or future-value calculation is illustrative only. Future events and actual outcomes are uncertain.

Past performance, assumed growth rates or historical market behaviour do not guarantee future performance.

10. Third-party information and links

The Service may contain information supplied by third parties or links to external websites. We do not control and are not responsible for the accuracy, availability, security, products, services or privacy practices of third parties.

11. Availability and technical issues

We do not guarantee that the Website, a Calculator, Report or email service will always be available, uninterrupted, secure or error-free. Results may be affected by software defects, browser compatibility, network failures, third-party services, maintenance or unauthorised interference.

Users should not rely on the Service as the sole record of important information.

12. Limitation of liability

To the maximum extent permitted by law, NicheWeb and its officers, employees, contractors and licensors are not liable for loss arising from reliance on a Calculator, result, Report, projection, Subscriber communication or other content provided through the Service.

This includes loss arising from inaccurate inputs, unsuitable assumptions, changed circumstances, third-party conduct, missed opportunities, business interruption or decisions made without appropriate professional advice.

Nothing in this Disclaimer excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

13. Regulatory status

NicheWeb provides software and information tools. NicheWeb does not, by operating the Service, act as a financial adviser, credit provider, credit representative, insurance broker, insurer, accountant, tax agent or legal practitioner.

Any regulated service offered by a Subscriber is the responsibility of that Subscriber.

14. Jurisdiction

Calculators may be configured for particular countries or currencies. Localisation does not guarantee compliance with every law, product rule, tax setting or regulatory requirement in that jurisdiction.

Users outside Australia should obtain local advice before relying on any information supplied through the Service.
