Acceptable Use Policy

This Acceptable Use Policy applies to use of the NicheWeb Calculators website, hosted platform, calculator embeds, reports, APIs, customer portal and related services.

This Policy forms part of the Subscription Terms and Conditions between Clark Family Pty Ltd as Trustee for The Clark Family Trust, trading as NicheWeb Calculators (“NicheWeb”, “we”, “us” or “our”), and each Subscriber.

1. Purpose

The Service is designed to provide legitimate insurance, finance and related calculators, branded reports, usage information and lead-generation pathways. This Policy protects the security, reliability, intellectual property and lawful use of the Service.

2. General obligation

You must use the Service lawfully, responsibly and only for legitimate business purposes consistent with your Plan, the Subscription Terms and this Policy.

You are responsible for use of the Service by your staff, contractors, agents and anyone who accesses the Service through your account, Licence key, Embed or Subscriber Website.

3. Prohibited unlawful or harmful use

You must not use the Service to:

  • break any law, regulation, court order or legally binding obligation;
  • facilitate fraud, deception, identity theft, money laundering or unlawful financial activity;
  • publish false, misleading or deceptive representations;
  • harass, threaten, defame, discriminate against or unlawfully surveil another person;
  • infringe intellectual property, privacy, confidentiality or other rights;
  • collect information without a lawful basis, required notice or consent;
  • send spam or make unlawful telemarketing communications;
  • distribute malware, ransomware, spyware, viruses or harmful code;
  • promote or facilitate violence, exploitation or other serious harm; or
  • support any activity that could expose NicheWeb, another customer or a third party to legal or regulatory risk.

4. Licence misuse

You must not:

  • use a Licence on a domain that we have not authorised;
  • share, sell, rent, sublicense, transfer or publish a Licence key;
  • operate one Licence for multiple customers, businesses or domains unless expressly permitted;
  • remove, alter, suppress or bypass Licence, domain, subscription or Plan checks;
  • misrepresent the identity of the Subscriber or Authorised Domain;
  • continue using paid features after a Plan expires through technical manipulation; or
  • help another person do any of these things.

5. Copying, reverse engineering and competitive use

You must not, except to the limited extent that a law expressly permits and cannot be excluded:

  • copy, reproduce or republish a Calculator, Report template, workflow, interface or substantial part of the Service;
  • reverse engineer, decompile, disassemble or attempt to discover source code, formulas, security controls or non-public APIs;
  • extract calculator logic, questions, assumptions, output text, report structures or data at scale;
  • create a derivative, competing or substitute service from the Service;
  • use the Service to benchmark or train a competing calculator platform without written permission;
  • frame, mirror or proxy the Service in a way that conceals its origin or defeats access controls; or
  • remove copyright, trade mark, attribution or proprietary notices that your Plan requires to remain visible.

6. Automated access, scraping and APIs

You must not use bots, crawlers, scripts, headless browsers, automated form submissions or other automated systems to access the Service except:

  • ordinary search-engine indexing that complies with our published technical instructions;
  • approved integrations using documented methods; or
  • where we have given prior written permission.

You must not:

  • scrape Calculator content, results, reports, leads or account information;
  • send automated calculations or Report requests intended to consume limits or degrade service;
  • use an undocumented endpoint or reverse-engineered API;
  • circumvent rate limits, quotas or Report allowances; or
  • rotate IP addresses, domains, accounts or identifiers to avoid controls.

7. Security interference

You must not:

  • probe, scan or test vulnerabilities without our prior written approval;
  • attempt unauthorised access to accounts, servers, databases or networks;
  • intercept, decode or manipulate traffic to or from the Service;
  • defeat authentication, encryption, access controls or security monitoring;
  • introduce malicious code or exploit a vulnerability;
  • conduct denial-of-service or load attacks;
  • use another customer’s account, data or Licence; or
  • publish vulnerability details before we have had a reasonable opportunity to investigate and remediate them.

8. Excessive or abusive usage

You must not use the Service in a manner that materially exceeds normal human or website-visitor usage, unreasonably consumes infrastructure, degrades performance or interferes with another customer.

Examples include:

  • very high request rates unrelated to genuine visitor activity;
  • repeated generation of duplicate Reports;
  • using a public Calculator as a bulk calculation engine;
  • automated testing against production systems without approval;
  • large-scale email generation or forwarding; and
  • attempting to use a Calculator as a general-purpose public API.

Where usage exceeds the reasonable scope of a Plan, we may contact you to reduce usage, apply technical limits, require an upgrade or agree a custom plan.

9. Prohibited content

You must not submit, display or transmit content that:

  • is unlawful, fraudulent, defamatory or misleading;
  • infringes copyright, trade marks or other rights;
  • contains malicious code or unsafe links;
  • impersonates another person or business;
  • misrepresents regulatory approval, licensing or affiliation;
  • contains sensitive personal information that is not necessary and lawfully collected;
  • promotes unlawful lending, insurance, investment or financial schemes; or
  • could reasonably damage the Service, NicheWeb or another customer.

10. Branding and representations

You must ensure that Subscriber branding, business details, disclaimers and calls to action are accurate and current.

You must not:

  • claim that NicheWeb endorses your business, advice or products;
  • present an estimated result as guaranteed, approved or binding;
  • describe a Calculator as personal advice where it is not;
  • remove or obscure required assumptions or disclaimers;
  • use NicheWeb trade marks without permission; or
  • create confusion about who operates the Subscriber Website or provides any follow-up service.

11. Privacy, leads and communications

You must not use the Service to collect, use or disclose personal information unlawfully.

Where you receive Calculator User information, you must:

  • provide an appropriate privacy notice;
  • obtain consent where required;
  • use the information only for lawful and disclosed purposes;
  • secure it against unauthorised access or disclosure;
  • honour unsubscribe, do-not-call and contact preferences;
  • avoid misleading consent wording or preselected consent options where prohibited; and
  • delete or de-identify information when no longer lawfully required.

You must not sell lead information generated through the Service unless the individual was clearly informed and the sale is lawful.

12. Regulated activities

You are responsible for determining whether your use of the Service involves regulated financial services, credit activities, insurance distribution, tax services, legal services or another regulated activity.

You must maintain all licences, registrations, authorisations, disclosures and professional standards required for your activities.

The availability of a Calculator does not authorise you to provide a regulated service.

13. Testing and development

You may test the Service for ordinary implementation and quality-assurance purposes. Testing must be proportionate and must not affect production availability, consume unreasonable Report allowances or involve real personal information unless necessary and lawful.

Load testing, penetration testing, automated regression testing or security research requires our prior written approval.

14. Reporting concerns

Please report suspected abuse, security issues or unlawful content to:

Include the relevant domain, account, date, evidence and a description of the issue. Do not send passwords, complete payment-card numbers or unnecessary sensitive information.

15. Investigation and enforcement

Where we reasonably suspect a breach, we may:

  • review relevant account, technical and Usage Data;
  • request information or corrective action;
  • apply rate limits or temporarily restrict a feature;
  • remove or disable content;
  • suspend a Licence or account;
  • preserve evidence;
  • notify affected parties or authorities where required; or
  • terminate the Service in accordance with the Subscription Terms.

We will act reasonably and, where appropriate, give notice and an opportunity to remedy the issue. Immediate action may be taken for serious security threats, fraud, unlawful conduct or material harm.

16. Consequences and costs

You are responsible for reasonable costs arising from your deliberate or reckless breach of this Policy, including investigation, remediation and third-party claims, subject to the Subscription Terms and applicable law.

Suspension or termination for your breach does not create a right to a refund, except where required by law.

17. Changes to this Policy

We may update this Policy to address new threats, technologies, laws or Service features. Material changes will be notified in accordance with the Subscription Terms.
